The situation with the extension of the residence permit and obtaining work authorization can become a real challenge. In the case of our client, who had a residence permit in France under the status of a salaried employee, difficulties arose after changing employers. The new employer began processing the work authorization, but the residence permit expired before the procedure was completed.
The prefecture required a valid residence permit or a document for its extension in order to consider the work authorization. However, to extend the residence permit, it was necessary to have a work authorization from the new employer. This created a vicious cycle: neither requirement could be fulfilled without the other.
Nine months after the residence permit expired, it was possible to obtain a document from the prefecture confirming the legality of the stay in France during the consideration of the case. Now the new employer can complete the processing of the work authorization, and the process of extending the residence permit will continue.
